Terms of Service

These Terms of Service ("Terms") govern your use of this website (amandakendall.com) and any engagement of services offered under the name Capacity Creator by Amanda Jean Kendall, ABN 19 368 471 724, of Queensland, Australia ("Amanda Kendall", "we", "us"). By using this website or booking a call, you agree to these Terms.

1. Services

Amanda Kendall provides operational and administrative support services to a limited number of clients under the Capacity Creator engagement, as described on this website. Specific scope, deliverables and pricing for any engagement are confirmed directly with the client prior to commencement and are not altered by general marketing copy on this site.

2. Engagement Terms

Capacity Creator engagements run for a minimum term of one quarter (90 days), billed weekly, at the rate published on the private invitation page at the time of booking. Continuation beyond the initial term is by mutual agreement.

3. Bookings and Calls

Calls booked through this website are scheduled via Calendly, a third-party scheduling service. Booking a call does not itself create a service agreement; an engagement begins only once both parties have agreed to scope and terms.

4. Payment

Fees are payable in accordance with the payment terms agreed at the start of an engagement. Late or failed payment may result in suspension of services.

5. The Guarantee

Where a guarantee is stated in relation to a specific engagement (for example, that agreed tasks are completed professionally and on time), that guarantee applies only to work items formally agreed between Amanda Kendall and the client, and does not extend to work outside the agreed scope.

6. Confidentiality

Amanda Kendall treats client information, documents and communications as confidential and will not disclose them to third parties except as required to deliver the agreed services or as required by law.

7. Intellectual Property

All content on this website, including copy, branding and imagery, is the property of Amanda Kendall unless otherwise stated and may not be reproduced without permission.

8. Limitation of Liability

To the maximum extent permitted by law, Amanda Kendall's liability arising from services provided is limited to the fees paid for the specific engagement giving rise to the claim. Nothing in these Terms excludes any consumer guarantee or right that cannot lawfully be excluded under Australian Consumer Law.

9. Termination

Either party may end an ongoing engagement in accordance with the notice terms agreed at the start of that engagement.

10. Governing Law

These Terms are governed by the laws of Queensland, Australia, and both parties submit to the non-exclusive jurisdiction of its courts.
